309. THOMAS BUTTS was indicted for stealing a wooden firkin containing 56 lb. of butter, value 30 s. the property of Thomas Hodges , March 3d .

'The prisoner was found by the watchman

'in the prosecutor's cellar; a firkin of

'butter was missed but could not be traced

'into the possession of the prisoner, and it was

'never found'

NOT GUILTY .

Tried by the Second Middlesex Jury before Mr. Baron EYRE .
