<interp inst="t18860405-name-468" type="given" value="THOMAS"/>THOMAS CHAFFERS</persName> </hi>. I live at 77, Ernest Street, Mile End, and am an insurance agent—I have served 30 years in the Army—on 7th February, between seven and eight, I was in the Whitechapel Road, and</p>

<p>about East Mount Street, opposite the Hospital Tavern, five men set about me; one of them came to my front—Humphreys put his hand under my overcoat and tried to get my gold albert and watch, at the same time I received a blow at the back of my head from Gibbs, who knocked me at the same time on my left leg and threw me forward violently on the ground—I got up and attempted to go after Humphreys—they had all gone away, but Humphreys, who had stolen my watch, had not got so far away as the others—before I had got two yards I was tripped up by Gibbs and thrown violently to the ground again; I tried my best to go after them and sang out "Stop thief" and "Police," but found they had got too far from me; I went to the station and gave the description of these two men and also of the property I had lost—I have never seen my watch and chain since, they were worth £7 10
<hi rend="italic">s</hi>.—I saw the prisoners eight or ten days afterwards and identified them from twelve others at the police-court—I have not the slightest hesitation—this happened in the wide open Whitechapel Road; I should think there were twelve lights outside the Hospital Tavern, within four yards of this—it was as light as day and I saw the prisoners distinctly—there were five men altogether, three had gone on and Gibbs and Humphreys were behind—I have no doubt about them—I was laid up for a week and have still a bandage on.</p>
<p>
<hi rend="italic">Cross-examined by Gibbs.</hi> I reported at the police-station within twenty minutes after it happened—I did not come to identify you with another prosecutor nor with a detective.</p>
<p>
<hi rend="italic">Re-examined.</hi> The detective did not give me the slightest hint as to which one to pick out.</p>

<hi rend="smallCaps">PAYNE</hi> (
<hi rend="italic">Detective Officer</hi>). On 10th March I went with another con
<lb/>stable to a beer-shop in King Edward Street, Mile End, and in the tap-room saw Gibbs and Humphreys—I told Gibbs I should take him for committing several larcenies from the person on different dates; he said "All right"—on the way to the station he said "You will get it up for me"—at the station he was placed with ten or twelve others and identified at once by Chaffers; when charged he said nothing—I found on him 13
<hi rend="italic">s</hi>. in silver and some coppers, a chain, a key and a knife.</p>
<p>
<hi rend="italic">Cross-examined by Gibbs.</hi> The conversation was just outside the public-house—I did not take you before because I had no idea before that you were the man who was doing these larcenies; it was from information I had afterwards, and I took you the night after I got it—I have not stopped you in my life except when I have taken you into custody—I got a description of you from the information—you were not put under the standard.</p>

<hi rend="italic">Re-examined.</hi> I had not seen Gibbs from nine to twelve months, I should think, before I took him.</p>

I went with Payne to this beerhouse in King Edward Street—I saw Humphreys there, and directed an officer to take him—he was told in my presence that if identified he would be charged with being concerned with others in committing various larcenies from the person—he said, "All right, I will go"—at the station he was placed with about ten others, and was immediately identified by the prosecutor—he made no reply when charged—I gave the prosecutor no description and no hint as to the men.</p>

<hi rend="italic">Gibbs stated in his defence that he was a ticket-of-leave man, and that the detective had an animosity against him. Humphreys asserted hit innocence, and said that the man who did it was described as a dark man, and that he was not dark.</hi> </p>
