1223. WILLIAM BROWN , stealing 9 pairs of stockings, value 6s.; the goods of John Weatherby: having been before convicted.

JOHN WEATHERBY . I am a hosier, and live at 90, Lower Marsh, Lambeth. On Saturday night, 11th May, I was fetched to the station-house—I missed about nine pairs of stockings, or it might be a pair or two more—they had been on a shutter under my window—I found my stockings at the station—these are them(produced).

THOMAS JAMES PAINTER . On 11th May, I saw the prisoner passing over the road—I went up to him, and said, "Halloo! what, thieving again"—I took hold of him—he turned, and began to kick and bite me—he dropped these stockings—he struggled to get away—I said, "I know you; you are a regular thief; I had you before"—I held him as long as I could—he fought me in a desperate manner, and had it not been for assistance, I should have lost him—I gave the stockings to the policeman—the prisoner bit me through the knuckle.

BARNETT SIMHONS . I am assistant to my brother, Coleman Simmons, of 93, Lower Marsh, a tin-plate worker. On 11th May, I saw the prisoner go towards Mr. Weatherby's—I told Mr. Painter of it, and while I was talking to him, the prisoner came by with the lot of stockings—Mr. Painter went and took hold of him—he said, "Halloo! what, thieving again"—he bit and kicked Mr. Painter—I came up, and he threw me twice—he would have got away, but the constable came up—he threw the constable twice.

JESSS RUTLAND (police-sergeant, L 28). I took the prisoner—the stockings were brought to the station by Mr. Painter—the prisoner was very Violent; I was obliged to get assistance from another officer.

WILLIAM BROAD (policeman, L 82). I produce a certificate of the prisoner's former conviction, at Newington—(read—Convicted Jan., 1850, and confined three months)—the prisoner is the person.

GUILTY . Aged 23.— Confined One Year.
