472. EDWARD WELCH was indicted for stealing, on the 13th of December , 1 watch, value 3l., and 2 watchkeys, value 6d., the goods of Dennis Sweeney , from his person .
DENNIS SWEENEY . I went to a funeral on the 13th of December, and the prisoner was one of the party; we went into a public-house, and had about three gallons of beer; we then went to another house, and had some more- when I came out I pulled out my watch, and looked at it; I asked my brother-in-law the time, and the prisoner came and put his hand round me - I thought it was out of friendship; my watch was taken from me, and the prisoner put his hand behind him to his brother, as he called him - I kept the prisoner till he was taken,
Cross-examined by MR. PHILLIPS. Q.Was he not liberated that night? A. Yes; I perhaps had not drank half a gallon - I had had as much as would do me good.
ELIZABETH SWEENEY . I was behind my husband when the prisoner drew him of his watch; my husband took him by the collar.
Cross-examined. Q.What were you drinking? A.Beer, and the women had a little gin and water; the prisoner was set at liberty, but he gave the watch to his brother.
