David White , Gent. was Tryed for killing one Thomas King , Gent. on the 19th Instant, of which he dyed the 22d, of a Wound given by a Sword, value 5 s. The Evidence swore, That the Prisoner was seen to push at the Deceased, upon which Mr. King fell down; and the Prisoners Sword was besmeared in Blood; and they were both much in Drink; but it was proved, that the Deceased gave the Prisoner a very great Affront before any Sword was drawn; he was found Guilty of Manslaughter .
