<p>A MOTION was made and QUESTION put, That the whole Proceedings on the King's Commission of the Peace, Oyer and Terminer, and Gaol Delivery for the City of London, and also the Gaol Delivery for the County of Middlesex, held at Justice Hall in the Old Bailey, be regularly, as soon as possible after every Session, published by the Recorder, and authenticated with his Name: The same was resolved in the Affirmative.</p>

<xptr type="pageFacsimile" doc="177607100004"/> came into the shop under pretence of buying a gown (I think they said the gown was for the prisoner) but they did not buy any thing; a woman in the shop told us the prisoner had concealed a piece of lawn; I searched her and found a piece of lawn concealed under her cloak.</p>
<p>[The piece of lawn was produced in court, and deposed to by Mr. Jenkins.]</p>
<p>The prisoner did not say any thing in her defence.</p>

<join result="offencePlace" targOrder="Y" targets="t17760710-20-off90 t17760710-20-crimeloc92"/>: on the 5th of June, between eight and nine in the morning, I met the prisoner in the laundry at the top of the house; I remember his person perfectly well; he bid me good morning, so did I him: our house was repairing; I thought he had belonged to the plaisterer, as I had desired the master plaisterer to send another man the day before, but as he was a stranger, I thought I would go and ask him if he was sent by the plaisterer, but being a little flurried I hesitated, and saw him watching me; I watched him; soon after he went down and went out, and left a plaisterer's fork in the passage, and left the door open. I was surprized, there being no body in the house but us two, and thought he should not be there: the cook immediately came in, and I asked her who she had had in the house; she said no body but the painters, who had been unloading the paint, and were gone to breakfast and would return presently; I said she had left the door open, and there had been a man in the house who had not the appearance of a painter, and asked if the plaisterer had sent another man; she said, no; I told her I had met a man in the house, who I believed came on no good design; she said
<xptr type="pageFacsimile" doc="177607100010"/> the painter would be there presently, and I might see if he was the man; the painter came, and I saw he was not the man; I then suspected it was a thief, and went up into the room where I saw him; there I found a cloth which I had put over a cabinet to keep it from the dust, removed, and the cabinet broke open and all the things mentioned in the indictment gone: they were found pawned at five different pawnbrokers: I am very sure the prisoner is the man, because he spoke to me: the things are my property; there was nothing of my mistress's gone; I was at the drawer, and saw them the night before. I told the painter we were robbed, and asked him if he saw any body in the house; he said he saw a man come in as he went out, and that he appeared to be a plaisterer; by the description he gave of him, I knew he was the man I met; I can swear positively that the prisoner is the person. I said, let me look at him again; I looked at him, and said he was like the man that came for the wine, but only he was not so drunk as he was: I am sure he is the man.</p>
<p>From the Prisoner. Did not Sheldon say, do you know the man, and you said no? - He asked if I knew the man; the answer I made was, this looks like the man that robbed me of the wet linen; I did not say no at first.</p>
<p>Had not Sheldon at the time told you this was the man that came for the wine? - No; he said, is this the man that robbed you?</p>
<p>What did Sheldon say more? - He said nothing, but went and sat down; there was nothing of the wine mentioned: I am clear he is the man that took my linen.</p>

<p>Was he drunk then? - No; he would insist upon my having something better, and asked me what I would have; I told him I would have a pint of red port mulled, and he went and brought it.</p>
<p>How was he after he drank that, was he sober? - Yes; after that pint was out he said he would fetch a second pint, and then he would wish me good night; he went away, and did not return; the maid brought the second pint.</p>
<p>What time did he go for the second pint of wine? - I think it must be full ten o'clock; the maid came again in about ten minutes after she brought the wine, and said they had been robbed; I met the prisoner this day fortnight in St. James's Park, and took him; I was determined to take him whenever I met with him.</p>
<p>From the Prisoner. Did not Mrs. Bursell say she did not know me? - Yes, I believe she did at first.</p>
<p>COURT. Repeat the conversation that passed between Mrs. Bursell and you. - I brought the prisoner to Mrs. Bursell's, and met her in the passage; I said, Mrs. Bursell, do you know this gentleman? she looked at him very stedfastly, and said, No, I do not.</p>
<p>Was there a light in the passage? - It was about twelve at noon.</p>
<p>What did you say upon that? - I said, don't you remember being robbed? this is the man that came for the wine; she then said, O law! I think I recollect his face.</p>

<p>What did she say when you took him into the kitchen? - I took him into the tap-room; nothing else was said; I did not take him into the kitchen at all.</p>

<p>I am a watchman: I met the prisoners and and another in company with them about a quarter before four in the morning on the 29th of June, near Colbrooke-row; I thought they were thieves, as they were looking into the gardens, and watched them; I saw Jones lean over into a garden and take some linen and put it into the other prisoner's hand; I immediately pursued and took them, and found the handkerchief, the jam, and a bit of rag in Wright's apron; Jones went down on his knees, and said he would do so no more; I took them to the cage, and went in the morning to the people that the things belonged to.</p>
<p>Wright and I were going to see after some work; I went to ease myself, and saw this bundle lie up in a corner; I went to see what it was, and put it in his apron.</p>

<p>What were the contents of a piece? - Generally about 70 yards, but one of them was a short piece; the six pieces contained 380 odd yards; there were seven yards of peagreen silk barred with silver; there was 20 lb. weight of silk died black; there was a draught upon my banker for 10 l.</p>
<p>Who is your banker? - Boldero, Barnston, and Co. No 5, Mansionhouse-street; and there was 2 l. 15 s. in money, that is all that I can be certain of.</p>
<p>How long before you missed them had you seen them in the house? - I left the house on Saturday, and left the foreman in the house; on the Saturday following I found the six pieces of silk in the possession of Mr. Worthy, Hanway-yard, Oxford-road; I have found nothing else but the draught: one of Sir John Fielding's men came to me on Saturday morning, and told me he had found the draught upon the prisoner Connor; the silk has been ever since in the care of Mr. Stellings; he is not here, but his head man is. (The draught produced by Heley;) that is my draught. - (The pieces of silk produced); I believe them to be my property; I was out of town at the time of the robbery; one or two I cannot swear so positively to as my man can; these answer to what I lost as near as can be; I believe them to be mine; they measure the same as what I lost.</p>
<p>Did you look where your house had been broke? - Yes; they had broke through the yard into a lobby where the work-people are served; they cut a hole through the door, and then broke through another door into the warehouse; they cut two holes through each door; I believe one was large enough to get their arm through; they were cut over where the bolts were.</p>

<p>I am foreman to Mr. Mason; I lie in the house; I went to bed on the 24th at a little after twelve o'clock; Mr. Mason's sister was up after me, but she knows nothing of the fact; I went into the warehouse after twelve, and saw that all was safe; the warehouse is part of the dwelling-house; it was formerly a back parlour; I was last in the warehouse, and locked it after me; I saw one of the doors fast; I did not open that to go to see the other door.</p>
<p>Had you fastened up the lobby where they broke in? - I fastened that up at seven o'clock; the maid was up before me in the morning; she called me at seven; I was the first that discovered the breaking of the place; as soon as I came to the warehouse door, I found that the lock had been forced off.</p>
<p>Are you sure that was whole and locked over night? - I am very positive of it: I entered the warehouse, and saw the things all in confusion; I went to the door that leads into the lobby; there were two holes cut in it; it had two bolts and a lock; there was a hole cut over the lock that commands that; I then went to the outer door that leads into the yard, and saw that cut in like manner.</p>
<xptr type="pageFacsimile" doc="177607100015"/>That was whole when you locked it at seven o'clock? - Yes; the outer door next the yard, and the door of the warehouse were broke; I searched the warehouse to see what was missing; I saw the till broke open, in which the draught of 10 l. lay; I put it in the till over night, which Mr. Mason left with me, left I should want cash in his absence; this is the draught, I recollect it perfectly, and I know it to be Mr. Mason's hand-writing.</p>
<p>Look at the silks. - They are the property of Mr. Mason; I am very positive of it; I know them well; there is a mark with a black-lead pencil of my own; I know the other by the work; I took them in that very day; there were 20 lb wt. of silk died black, and seven yards of pea-green silk, barred with silver, and there were about two pounds fifteen shillings in cash lost; I had it in my hand over night: the silks were found in the possession of Mr. Worthy, the draught I saw at Sir

<p>I am a silk-mercer; I gave Mr. Mason information of these silks; I went on a Friday evening to buy some tabbies of Mr. Worthy; I have bought tabbies very often of him to send in the country; these black silks lay on the compter open, not rolled; these in particular, and some others, he told me he could sell them me a Jobb: I asked him the price of them, he said 5 s. 6 d. a yard all together one with another; I had heard before of Mr. Mason's house being broke open; it struck me that these might be the goods; Mr. Mason had told Mr. Stellings, at whose house I am, and he told me.</p>
<p>Prosecutor. The silks one with another are worth about 6 s. a yard.</p>
<p>ELAM. I told him I would not buy them that night, but would be with him by seven o'clock next morning; I came home and told Mr. Stellings what goods I had seen; he said it was much if they were not Mr. Mason's; I went to Mr. Mason's, and told him I could buy silks cheaper than he could make them, joking; I then told him what goods I had seen; he said they were his property, and went with me to Mr. Worthy's; there he looked at the things, and said they were his; Mr. Worthy said he should be happy to discover the thief; I blamed myself then for not having told Mr. Mason the night before, as I found Mr. Worthy had not paid for the silks till that morning.</p>

<p>Did he say where he bought them? - No.</p>
<p>Or in what manner? - No; he said he bought them of them, and produced a bill of parcels of them before I paid him for them. [The bill of parcels produced]</p>
<p>Do you know Still and Baker's hand-writing? - No.</p>
<p>That you had from Edrian? - Yes; I understood him that he was to give but 3 s. 6 d. a yard; the bill of parcels is 4 s. 6 d. it was a mistake, because I had not the bill of parcels then; my brother had it; he was to pay the money.</p>
<p>The bill of parcels was not delivered till the money was paid? - Yes; we had it before; but I did not see till Saturday morning.</p>
<p>These are the goods? - Yes; these are the goods I bought of Mr. Edrian, and offered to Mr. Elam; they were loose, because I had just measured them; they came to me folded, not upon rolls: I have dealt with him for silks before; I had no suspicion of him.</p>
<p>What are the silks worth to a wholesale dealer? - I think, to pay ready money, they are worth 5 s. 6 d. a yard.</p>
<p>You don't know Major Baker and Still? - No.</p>
<p>Was you not surprized to think of his buying these silks at 3 s. 6 d. a yard? - I thought it a low price; but knowing him so long, I had no suspicion that they were stole.</p>

<p>I lent Baker 14 guineas to pay for some goods; when I went to him for it again, he said he could not pay me, for that Worthy would not pay for the goods without a bill of parcels; Baker asked me to write a bill, I said I would write it, or get it wrote, accordingly I went to Hobbs and got him to write the Bill of parcels; when Worthy came and presented the bill to me, I said it was very well, and went up stairs, and left them in the parlour. One of the men that stood by the horse had a pistol, the other three had cutlasses.</p>
<p>What light had you? - It was about ten o'clock at night; it was such a light that I distinguished them at about 40 yards distance.</p>
<p>Could you distinguish a face at that distance? - Yes.</p>
<p>Could you distinguish the faces of any more of the men? - Yes; Davis was the person that had the pistol and stood at the horse.</p>
<p>Do you recollect the face of any other? - As to the face the light might deceive me.</p>
<p>Might it not deceive you with regard to Davis too? - If it might deceive with respect to one, it might deceive with respect to the other.</p>
<p>Then you will not take upon you to swear to either of them? - I think the prisoners are exceedingly like them; I think I know Davis's voice too; he said, when he came up to the chaise, You bloody dog, deliver your money; I heard him speak at Sir

<p>What had you in your hand? - A pistol.</p>
<p>Did any body stand at the head of the horse? - Yes, Davis; he stopped the horse; he stood at the horse a little while and then he came up to the chaise; M'Coul got into the chaise, and he and Hollis took the money; I saw them take the money; they gave me a share of it.</p>
<p>M'COUL's DEFENCE.</p>
<p>It was but a week before that time that I was taken up by Justice Welch's people, and I was discharged; my friends hearing I was likely to come into bad circumstances, they arrested me, and put me into a spunging-house, upon my promising to be good, which was my resolution; I was let out, that was on Friday night; my father is ready to prove that I was not out that week, for I had not a coat to go out in.</p>

<p>Where was he at ten o'clock? - With me; and we had part of a cold calf's head for supper, the remains of what we had for dinner.</p>
<p>Where do you live? - At No 29, in Fleet-lane.</p>
<p>What time did he go to bed? - After supper, about eleven o'clock.</p>
<p>Are you certain of that? - Yes: he dined about two o'clock; he went out after he had dined, and came home about seven in the evening.</p>
<p>You are positive of that? - Very sure; he staid at home and we supped, and I was very happy to think I had him at home, and said, I hope you will never be in trouble any more; he said, No, he would go to sea as soon as he could get a birth: I told him, I feared he would be hanged if he did not.</p>
<p>Was there any body else there? - I had nobody else there but my wife and children; I have been a prisoner in the Fleet these two years.</p>

<join result="offencePlace" targOrder="Y" targets="t17760710-35-off161 t17760710-35-crimeloc164"/>, because they had a friend there; when we came there the 'squire asked who had gained or lost; the prisoner said, you have gained to be sure; they went to the bar and called for a half-crown bowl of punch, and went into a room, and I told down a hundred guineas upon the table; when I had told it down, the prisoner said he had been to his landlord, and he was not at home; that he could get but fifteen guineas, and if I would let him have 85 of my guineas in his hand, just to shew the company, he would return them to me directly; I gave him the 85 guineas, and as soon as I had done that the cards were produced on the table, and they began to cut the cards very fast among themselves; at last they prevailed on me to cut the cards; I did three times, once for five guineas, another time for ten guineas, and the third time for five, and lost every time; all above five was my chance, and all under five was their chance; when I had lost that, I snatched the cards out of their hands, and they were only twos and threes; then I said I believed they were rascals, and I would cut no more; the other two went out then with a pretence to get a glass of peppermint, and I desired the prisoner to give me my money; O, said he, we must have these fellows back, they shall not go off with all the money they have won; and then he made a start and ran off; I ran after him, but could not catch him, and I never saw him again till I met him last Monday fortnight, when I had him secured.</p>

<p>Then they did not know you? - No: I stopped at the Mackerel at Mile-end, and told a neighbour I suspected I had some things in my cart that were stolen; he advised me to open the bag; I did, and immediately the man ran away; we secured him, and carried them before Justice Curtis, who committed them.</p>

<join result="persNameOccupation" targOrder="Y" targets="t17760710-38-victim340 t17760710-38-viclabel180"/>; I lost the things mentioned in the indictment out of my room on the 5th of May, between the hours of three and four in the afternoon, while I was at church; they were locked up in a trunk in my bed-chamber; when I returned my room door was opened; I left the trunk both locked and corded when I went out; there was a small trunk and a box in the inside of that trunk; the trunk was opened, and there were two trunks belonging to a gentleman broke open; I advertised them the next day, offering half-a-guinea reward for the recovery of them:
<xptr type="pageFacsimile" doc="177607100028"/> from the information of one Mrs. Persley I suspected the prisoner, and took her before Justice Sherwood, but not being able to prove any thing against her she was discharged: I heard after we came from the justice's that the prisoner had another lodging in the Borough: I went to St. Margaret's Hill and got a warrant, and some of my things were found at the prisoner's brother's in the Borough. (The cotton gown and the dimity which were found at the prisoner's brother's were produced in Court, and deposed to by the prosecutrix.) The prisoner's father's apprentice-boy went with me to shew me where the prisoner's brother lived; his apprentice-girl informed the justice that the things had been pawned and taken out again and carried to the brother; both the boy and girl are kept back by the prisoner's father.</p>

<p>I am a constable in the Borough; the prosecutrix brought me a search warrant to search the prisoner's apartment; I searched it, but found nothing at all there; I put the prisoner and the apprentice-girl in the county gaol, and then the girl said that her mistress, meaning the prisoner, had sent her with a bundle to her brother's; I knew the brother and all the family very well; I went there, and found the bundle. The girl is bound over to appear, but the prisoner's father would not let her come. I found the dimity at a pawnbroker's.</p>

<p>I am servant to Mr. Robinson; I fastened all the doors and windows in the dusk of the evening on the 11th of June; there was no one in the house but myself; I went to bed a little after eleven; at about half after two or near three in the morning the watchman came up to my chamber door and told me the house was broke open; I came down in a few minutes, and found my master's dressing-room door broke open, and some of the drawers broke open and others unlocked; some of my master's cloaths lay on the floor: my master was in the country; I did not know myself what was in the drawers.</p>

<p>I am steward to Mr. Robinson; I was with him in the country on the 12th of June; an express came from town that my master's house was broke open the night before; I came to town immediately, and found his study broke open, and the bureau and most of the drawers broke open; the maid had the key of the room door; I had the key of the drawers; I went out of town on Saturday the 8th: I had an account of the things; I missed twenty-five pair of silk stockings; I took the account of the things a year before; I saw all the things
<xptr type="pageFacsimile" doc="177607100029"/> were there, according to the account, before I went out of town (repeating the cloaths mentioned in the indictment). I am positive to the shirts and stockings; I did not see the falts and plate, they were left in the closet by the butler; the shutters were broke open by which they got in, and the study door was broke open: the crows were found afterwards; I tried them, and they fitted the marks in the study door; the drawers were opened by a key which they found in the bureau.</p>
