The Prisoner in his Defence said, that he had been at his Sisters, and seeing a Crow'd on Long Hill, stopt to see what was the matter, and the Prosecutor followed him and charged him with the Fact, which he said he was innocent of. But the Prosecutor, was very politive that he was the Person. The Jury found him

<join result="persNameOccupation" targOrder="Y" targets="t17190903-2-defend32 t17190903-2-deflabel10"/>, and took the Rings out of a small Trunk, and sold one near the Hospital Gate, the other two in The Prisoner acknowledged she took the Rings and sold them for want, and had agreed with her Mistress to pay her for them by one Shilling per Week till the whole Money should be out; but failing in her Payments occasioned this Prosecution. The Jury considering the matter

Another Evidence deposed that as he was going to work betimes in the Morning he saw the Gown hang down under the Prisoners Coat, who being in a ragged Condition he suspected, and speaking to some others who came by to assist him, seized him and had him before the Constable. The Constable deposed that he found the Gown upon the Prisoner, who confest to him that he broke a pain of Glass and took it out of the Window. His Examination was also read in Court. But the Evidence not being sufficient to prove that the Fact was committed in the Night-time, the Jury

<join result="offencePlace" targOrder="Y" targets="t17190903-4-off18 t17190903-4-crimeloc21"/> by the Custom-house to drink, and sat in the Publick Room; that the Prisoner sat down by him, and he pulling out his Money (half a Guinea and a Sixpence) to pay his Reckoning she clapt hold of the half Guinea, put it into her Mouth and sollowed it; and pickt the two Necks out of his Pocket. The Prisoner in her Defence said, that the Prosecutor ask'd her to whip him, and brought Rods; that she did whip him behind, and he not being contented with that, gave her half a Guinea to whip him before. But the Jury not believing her, and the two Necks being found upon her, found her

The Prosecutor deposed that the Prisoner and a Man who pais'd for her Husband, came to his Shop to cheapen Callicoe, that they tumbled several pieces, but did not like; at last they bought two yards, paid for them, and went away; that while he was putting up his Goods again, a Porter came to him and ask'd

Another Evidence deposed. that he met the Prisoner and a Man with her, and seeing a piece of Callicoe hang under her Petticoat, secured her,(but the Man got away) and carried her to the Paul's Head in Lawrence Lane, and sent for the Prosecutor, who came and owned the Goods. There were other Evidences who confirmed the taking the Goods upon her, one Piece was found first, and the other taken from between her Legs. The Goods were produced in Court and sworn to by the Prosecutor. The Prisoner in her defence said, her Husband gave her the Callicoe to Cloath her Children, and endeavour'd to prove it by calling her Landlord, who deposed that her Husband came that Morning and ask'd her to go out with him to buy Callicoe for the Children; and another who deposed that he saw a Man sling a piece of Callicoe into her Apron. But the Fact being so plain upon her, the Jury found her

The Prisoner in his Defence deny'd that he knew any thing of their going away with the Candle-sticks; but it appearing plainly by the Evidence that it was a Contrivance between all three of them, the Jury found him

The Prosecutor deposed that he went over the Water to buy some Goods, but not buying them brought his Money back again, and when he landed the Waterman quarrel'd with him about his Fare, and took him by the Collar; that the Prisoner,

<interp inst="t17190903-19-person111" type="gender" value="male"/> </persName> took his Part and went down to take the Number of his Boat, but could not see any, and then threatning to have the Waterman before a Justice of Peace, he complied and took his Money; that he thank'd them for their Civility and offered them a Bottle of Wine, and accordingly they went to Mr. Trendy's in St. Pauls Church Yard, and staid there till about half an hour after Eleven a Clock; that Withie and Drake wentforward , and the Prisoner and himself went up the Old Bailey; that he would have parted with him there, but the Prisoner would needs see him home; which made him afraid he had a Design upon him; that they went to his Door together, where he knockt, but could make no body hear; then they went to his Barber's hard by, and found no Body there but the Boy hitting up for his Master; that he gave the Gold mentioned in the Indictment done up in his Handkerchief to the Barbers Boy to lay up and keep safe for him till he call'd for it, and then went home. The Barber's Boy confirm'd the Prosecutor's bringing the Money, and the Prisoner's being with him; and further deposed. that a little while after they were gone, the Prisoner came back again, and said he had seen Mr. Cooper safe home. and he had sent him back for the Money he left with him just now; whereupon the Boy delivered it to him, and he went off with it. The Prosecutor and the Boy were positive the Prisoner was the Man . The Prisoner denyed the Fact, and said that he was not in their Company all that Night, and called the following Evidences to prove it.

<interp inst="t17190903-19-person114" type="gender" value="male"/> </persName> , were the Persons who were in Company with the Prosecutor that Night upon that Occasion, and that the Prisoner was not with them; that Murray and the Prosecutor went together, and that the Prosecutor's Handkerchief, which was produc'd in Court, he had of Murray, who now absconds for the same Fact. Mrs. Gill deposed, that the Prisoner odges in her House in Colemane-street, and was at home by half an Hour after 9 a Clock that Night at farthest, eat his supper and went to Bed and did not go out any more that Night; that she was sure it was the 25th because her Husband went out of Town that Day and return'd the next, being the 26th of June. Mr. Gill confirmed what his Wife had said relating to his going out of Town and coming home again, and added further, that when he came home, which he said was on the 26th about 4 in the Morning, he went into the Prisoners Room, and saw him in Bed. Another who lodg'd in the same House, deposed, that the Prisoner came home that Night about 9 a Clock. and that she remember'd the time because she paid her Rent the next Morning.2d about 9 a Clock, which was the Morning her Landlord came home from Rechester. He also called several to his Reputation who gave him a good Character, but being ask'd how he liv'd, or what he did for a Livelihood could give no account of that The Prosecutor also call'd some Persons to invalidate his Evidence, particularly that of Mr. Withie , one who deposed that he knew Mr. Withie and the Prisoner very well, and that they liv'd by Gaming. Mr. Withies Guardian deposed that his Friends had left him hansomly to live on, but that he has been a wild Young Man. The Jury consisidering the whole matter, brought him in

The Prosecutor deposed that another came into his shop with the Prisoner to be shaved, and when they were gone he perceived the lid of the Box in the Window open, and mist the Wig. which he had just before comb'd out and put into the Box, whereupon he follow'd them through Newgate into the Old Bailey, but they perceiving of him, separated, the other Person ran towards Pye-Corner, and the Prisoner down the Old Bailey, whom he follow'd and carryed into a shop that a Woman coming out at the very next Door took up the Wig and brought it to the Prosecutor who own'd it, two others confirm'd the finding of the Wig near the Prisoner in the Old Bailey. <xptr type="pageFacsimile" doc="171909030004"/> and bolted between 10 and 11 a Clock at Night, and between one and two was call'd up by the Watchman who told him his House was broke open by two Persons, and one of them was taken and in the Watchhouse; that he found his Door open, and went to the Watch-house, where he found the Prisonner. The Watchman deposed, that going his silent Watch, he saw the Prisoner and another rush out of the Prosecutor's House, in

The other Watchman deposed, that hearing the cry of stop Thief, and meeting the Prisoner running through the Court, he bid him stand, and the Prisoner said he would kill him; whereupon he struct at him with his staff and mist him, that he followed and struck at him again, when the Prisoner turn'd his Face, and the Watchman who cry'd out first came up and knockt him down. The Constable deposed that he went by the Prosecutor's Door a quarter after one a Clock and it was fast, and that in half an Hour time after the Prisoner was brought before him. The Prisoner deny'd the Fact, or that he was in the same street that Night, and said that having a child to be Christen'd he went to a Frind in Woods Close to ask him to stand Godfather, where he said till about 12 a Clock, and drank part of Bole of Punch, and as he was going home was knockt down by the Watch at Stocks-Market; that he did not threaten the Watchman and that he had no Arms, not so much as stick about him. His Friend conformed his coming to his House to ask him to stand Godfather to his Child, and the Drinking of Punch there, and that they parted between 11 and 12 a Clock. He called several to his Reputation, who gave him a good Character; but Evidence being very full against him, the Jury found him

The Goldsmith deposed that the Prisoner came to his shop in a Coach to see some Plate, that she looke'd upon some, but pretending not to like the Fashion , said she would call again; that she said she had a little Plate to sell, pulled it out and bid him weight it ; which he did, and paid her he produced in Court, and was sworn to by the Prosecutor . The Constable depos'd that going with a Search Warrant to Tayler's Cellar, found the Fork and some went Linnen there; and Taylor conselt where they had dispos'd of the rest, and they were found according to their direction. A Goldsmith deposed he bought the Buttons of Taylor for 14 s.6 d. Another deposed, that Taylor and her Daughter Mary Francis came together and sold him a small Ring for 4 s.6 d. that they came again with Gold Studs, and he examining how they came by them, Taylor said her Daughter's Sweetheart gave them her. Mary Francis confessed the Fact, and took it upon her self, saying that her Mother did not know they were stole, for she had told her they were given her. The Jury considering the matter,

The Surgeon deposed, that he had a Bruise on the Left side on the Temporal Muscle, and a Concussion of Blood on his Brain, which is present Death. The Prisoner denyed that he did it willfully, or that he whipt his Horses, or heard any body call out, and said it was so dark he could not see him.

Another corrobarated the Prosecutor's Evidence by deposing that when he came home he heard him declare the Prisoner was one of them that robb'd him. Another deposed that he saw the Prisoner and a short Fellow go through Islington together that Evening, towards Highgate. Another Person deposed that the Prisoner came to him to borrow a pair of Pocket Pistols to Shoot his Father; that he came a second time and would have bought them, and being ask'd for what use, said to go on the High-Way. The Prisoner deny'd the Fact, and called the following Evidences to prove that he was elsewhere that Night. Mr. Archer deposed, that the Prisoner was at his House (the Horseshoe in Clerkenwell-Ciose) from four a Clock till seven that Evening, and then went out for about half an hour, and return'd again, and staid till near 10 a Clock at Night; that the Prosecutor came to his House and said, that if Mr. Howard would make Oath that the Prisoner was in his Company at 10 a Clock that Night he would not prosecute him. Mr. Heward deposed that the Prisoner was in his Company till a quarter of an Hour before 10 that Night; and that he met the Prosecutor, who said to him, that if he would say it was 10 a Clock that Night before the Prisoner and he parted, he would not prosecute him. Another deposed he was in Company with Mr. Howard and the Prisoner at the Time and Place aforesaid. The Prisoner's Land-lord's Daughter deposed that she met him in Charteshouse-Lane a quarter of an Hour before 10 that Night, drunk and quarrelling with an Old Woman; that she forc'd him home along with her, and he was angry with her for so doing. The Prosecutor deposed, that the Prisoner was, his cousin, and had a Legacy of 4 l. left her by a Friend in Derbyshire, which was sent up to him for her; that he sent for her to receive the same, and fetcht down a Bag of Money and paid her out of it, and carried up the remaining Money, which was that mentioned in the Indictment, and put it in his Closet, and afterwards went out about his Business; that the Prisoner staid at his House and lay there that Night; that the next Morning being to go to Hatfield, he went to his Closet to look for his Money and it was gone, and concluded the Prisoner must take it. The Prisoner owned that she went to receive a Legacy he was to pay her, and that she lay there that Night, as she us'd sometimes to do, he being a Relation; but denyed that she knew any thing of the taking of his Money, and said that they search'd her and found nothing upon her; that there were two Servants in the House at the same time. <join result="offenceCrimeDate" targOrder="Y" targets="t17190903-48-off245 t17190903-48-cd246"/> last in the Night-time, and taking from thence 4 l. in Money, a piece of Gold value 10 s. a Sheet, a Pillow, an Apron and a Purse. </rs> The Prosecutor, deposed, that the Prisoners broke open her Door and bound her in her Bed with a Cord, and took away what she had; that Ward and Robbins came about six a Clock, and Dutton came after, and tyed her down; that she lost 4 l. in a Puise, and some Goods; and that Ward forc'd something very bitter down her Throat, which she supposed was to cause her to sleep. A Warder deposed that. Dutton came to him, the Church-Warden not being within, and Lid that Mary Stone was in a bad Condition, and if care was not taken of her she would long herself; that she came to him again, and gave him a piece of Gold, which he produc'd in court, and was sworn to by the Prosecutors. The Constable who took them up and carry'd along to Produc'd a Sheet, a Pillow, a Purse ,

The Prisoner owned both Marriages, and in her Defence said, that the last she was married to was no Man, and therefore could not be a Husband; that it was a Monster, a Hermaphrodite, and had been shown as such at Southwark-Fair, Smithfield, and several other Places; and called several Witnesses to prove the same; one whereof deposed, that he knew the Mother of it, who brought it up as a Girl in Apparel and at School, and to handle the Needle, till it was 12 Years old, when he turn'd Man and went to sea. She was also produc'd in Court, and own'd her being a Hermaphrodite, and having been shown; and it appearing by her own Confession as well as other Evidences that the Woman was more predominant in her than the Man, the Prisoner was

<interp inst="t17190903-53-person286" type="gender" value="female"/> </persName> deposed that the Prisoner came under pretence of taking a Lodging of her, and that they agreed together for one at 12 d. a Week, that the Prisoner sent for a Pot of Drink, and to return her Civility she fetch a Glass of Rum for the Prisoner, and reacht down a little Dish of Sugar to Sweeten it, in which Dish upon the Sugar were the Rings mentioned in the Indictment; that the Prisoner liked the Rum so well that she would needs have a penny worth more of it, and while she went down to fetch another Glass, the Prisoner took the Rings out of the Dish; that no body else was there all the time, and one of the Rings was found where the Prisoner had pawn'd it. The Prisoner in her Defence said, that she would have borrowed some Money of Mrs. Gates, but she having none to lend, gave her the Rings to pawn, and took her Note for the Money at an Allowance of 5 s. in the Pound, to be paid when her Husband came from Sea, but could not prove it. The Sixpence was produc'd in Court, and appear'd to be bent and batter'd , but not particularly mark'd; there were some other Circumstances alledg'd, as that he was not wihtin when they first came with the Warrant, and when they met him he refused to go before a Justice without the rest of the Lodgers, and that he was heard to say, if it was not for that Sixpence there would have been none of this Trouble, and that he kept unseasonable Hours; but the Evidence not being sufficient to six it upon the Prisoner, and he calling several to his Reputation, who gave him a good Character, some of whom had entrusted him confiderably, and always found him honest; the Jury
